Halle Berry has accused Gabriel Aubry of putting their daughter at risk in court.

The former couple is locked in a bitter battle over the care of three year old Nahla, and a lawyer for Halle has served a lengthy document claiming Gabriel has violated their custody agreement.

According to gossip website TMZ, the court documents go into great detail about how Halle is unsure of Gabriel’s parenting skills, including detailing one incident outside of the US, when he allegedly neglected Nahla, putting her safety at risk.

Oscar winner Halle – who split from Gabriel in April 2010 – is asking the judge to rule her ex-partner has violated their custody agreement. As he was not present in court, the judge has set a hearing for a later date.

Halle, 44, first raised questions over Gabriel’s parenting in January, and subsequently launched a bid for full custody of Nahla.

A spokesperson for the actress said at the time: “Halle has serious concerns for her daughter’s well-being while in the care of her father and is prepared to take all necessary steps to protect her.”

The 34-year-old model hit back at the claims however, calling Halle “irresponsible”.

He said in a statement: “Gabriel fully believes that a consistent and balanced living situation and two loving parents are crucial for their child.

“He will always defend his rights as a father and will always consider Nahla’s best interest. Halle’s continuing allegations in the press are untrue and irresponsible.”
